1. Agreement to these Terms
These Terms of Service (the “Terms”) govern access to and use of the CompoundCheck website at compoundcheck.com and the CompoundCheck application (together, the “Service”), operated by CompoundCheck (“CompoundCheck”, “we”, “us”, or “our”). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you are using the Service on behalf of a pharmacy or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.
2. The Service
CompoundCheck is clinical decision-support software for compounding pharmacies. It extracts ingredient and formulation information from uploaded compounding formula documents, cross-references that information against published hazard data sources, and produces draft risk assessments, Master Formulation Records, and related documentation aligned with NAPRA’s Model Standards for non-sterile compounding and informed by USP <795> and <800>.
The Service is currently offered as a closed pilot. Access is limited to invited participants, features may change without notice, and we may suspend or modify the Service as part of pilot operations. Joining the waitlist does not create an entitlement to access.
3. Professional responsibility — read this section carefully
The Service is a decision-support tool for licensed pharmacy professionals. It is not a substitute for professional judgment, training, or the standards and guidance of your provincial regulator. Specifically:
- Outputs of the Service, including risk classifications, personal protective equipment recommendations, and engineering control recommendations, are drafts until a licensed pharmacist has reviewed them, applied professional judgment, documented any overrides, and signed off.
- The licensed pharmacist who signs an assessment is responsible for the final decision, including the decision to compound, decline to compound, or escalate a preparation to a higher containment level.
- You remain responsible for verifying ingredient identity against the Safety Data Sheets on file in your pharmacy and for complying with your provincial regulator, NAPRA Model Standards, applicable USP chapters, and all applicable laws.
- The Service does not provide medical advice, does not dispense or prescribe, and does not create a pharmacist–patient relationship.
4. Eligibility and accounts
Accounts are intended for licensed pharmacy professionals and authorized staff of pharmacies. You must provide accurate registration information, keep your credentials confidential, and notify us promptly at contact@compoundcheck.com if you suspect unauthorized use of your account. You are responsible for activity under your account.
5. Your data
You retain all rights in the documents and data you upload to the Service, including formula documents and the assessments you finalize (“Customer Data”). You grant us a limited, non-exclusive licence to host, process, and display Customer Data solely to provide and improve the Service, consistent with our Privacy Policy. You are responsible for ensuring that Customer Data does not include patient identifiers or other personal health information; the assessment workflow is not designed to receive it, and the Service includes scanning that flags suspected identifiers in uploaded documents.
6. Third-party data sources
The Service cross-references published data sources, including the NIOSH List of Hazardous Drugs in Healthcare Settings (2024), PubChem GHS classifications, Health Canada’s Drug Product Database, and the EPA CompTox Chemicals Dashboard. These sources are maintained by their respective publishers on independent schedules, and we do not control their content. The Service records the dataset versions used for each assessment and flags ingredients it cannot verify. You acknowledge that published hazard data may change, contain errors, or lag new evidence, and that source verification remains part of the signing pharmacist’s professional review.
7. Acceptable use
You agree not to:
- use the Service in violation of applicable law or professional standards;
- upload content containing patient identifiers or personal health information;
- probe, scan, or test the vulnerability of the Service, interfere with its operation, or attempt to access data of another pharmacy or tenant;
- resell, sublicense, or provide the Service to third parties without our written agreement;
- use automated means to scrape the Service, other than search engines and AI assistants accessing public pages in accordance with our robots.txt;
- misrepresent the outputs of the Service, including removing pharmacist sign-off requirements, provenance notes, or draft markings from generated documents.
8. Intellectual property
The Service, including its software, rules engine, templates, design, and documentation, is owned by CompoundCheck and its licensors and is protected by intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you. Feedback you provide about the Service may be used by us without restriction or obligation.
9. Fees
The Service is provided without charge during the closed pilot. If we introduce fees, we will provide advance notice and the opportunity to stop using the Service before fees apply. Any future paid plans will be governed by terms presented at the time of purchase.
10. Availability and changes
We work to keep the Service available and accurate, but the Service is provided on a pilot basis and we do not guarantee uninterrupted availability, error-free operation, or any particular service level. We may modify, suspend, or discontinue all or part of the Service. If we discontinue the Service, we will make reasonable efforts to give you an opportunity to export your Customer Data.
11. Termination
You may stop using the Service and request deletion of your account at any time by contacting contact@compoundcheck.com. We may suspend or terminate access if you materially breach these Terms, if required by law, or as part of winding down the pilot. Sections of these Terms that by their nature should survive termination (including Sections 3, 5, 8, 12, 13, and 14) survive.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Without limiting the foregoing, we do not warrant that hazard data drawn from third-party sources is complete, current, or error-free, or that draft outputs are suitable for use without the professional review described in Section 3.
13. Limitation of liability
To the maximum extent permitted by applicable law: (a) CompoundCheck will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost data, or business interruption, arising out of or relating to the Service or these Terms; and (b) CompoundCheck’s aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the amounts you paid for the Service in the twelve months before the event giving rise to liability and CAD $100. These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnification
You will defend and indemnify CompoundCheck against third-party claims arising from your breach of Section 3 (Professional responsibility) or Section 7 (Acceptable use), or from Customer Data you upload in violation of these Terms, except to the extent the claim results from our own breach of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify account holders by email or in-app notice before it takes effect. The “Last updated” date above reflects the current version. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable in that province, without regard to conflict of laws rules. The courts of New Brunswick will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and you and we each consent to their jurisdiction.
